THIS IS A LEGAL DOCUMENT THAT AFFECTS YOUR LEGAL RIGHTS. PLEASE READ CAREFULLY BEFORE SIGNING.

I would like to visit and participate in activities and events (“Activities”) at Project Chimps, located in Morganton, Georgia. In consideration of being allowed to participate in such Activities, I, on behalf of myself and my personal representatives, assigns, heirs, and next of kin, hereby agree to the following:

1. Assumption of Risks. I understand that Project Chimps cares for chimpanzees, and I understand and acknowledge that there are potential and inherent risks involved in visiting a facility that cares for and houses such animals. These include, without limitation, the potential for animal bites and scratches, serious bodily injury, sickness and disease, permanent disability or paralysis, loss of life, accidents, and other unspecified risks or dangers that may not be readily foreseeable or are presently unknown (collectively, the “Risks”). I hereby expressly assume all such Risks and responsibility for any damages, liabilities, losses, or expenses I incur as a result of my participation in the Activities.

2. Waiver of Liability and Release. I acknowledge and agree that I am participating in the Activities entirely at my own initiative, risk, and responsibility. I hereby release, discharge, and hold harmless Project Chimps, their affiliates, and their respective directors, officers, employees, volunteers, contractor, agents, successors, and assigns (collectively, the “Releasees”) from any and all claims, demands, actions, causes of action, judgments, and liabilities of any kind whatsoever that may arise or result, directly or indirectly, from death, injuries, illnesses, diseases, or damages of any kind, foreseeable or unforeseeable, to me or to my property, incurred while I am participating in Activities or on the Project Chimps property. This includes, without limitation, damages of any kind to me or to my property arising or resulting, directly or indirectly, from negligent acts and omissions of any of the Releasees, to the fullest extent permitted by law.

3. Appearance Release. I understand that, from time to time, Project Chimps produces educational and promotional material related to its programs. I understand that as a participant to the Activities I may be included in videos or photographs taken during the Activities. I hereby grant to the Releasees the right to take videos and photographs of me and to use my name, and any video, film, pictures, photographs, silhouettes or other reproductions of my physical likeness on television, the internet, for publication in news articles or print, broadcast, digital, or online advertisements and publications of every kind or character in any purpose or connection wherever and by whomsoever published, circulated, or distributed without notification or compensation to me.

4. Other. I agree that this Release & Waiver of Liability (the “Release”) shall be governed by and interpreted in accordance with the laws of the state of Georgia and shall be construed as broadly as the state of Georgia laws allow. In the event that any portion of this Release is held to be invalid by a court of competent jurisdiction, the remainder of this Release shall nevertheless continue to be enforceable.

I hereby certify and represent that I am at least 18 years of age and am competent to sign this Release. I have read the foregoing and fully understand the meaning and effect thereof and, intending to be legally bound, I have hereunto set my hand on the date written below.

I am the parent or legal guardian of the minor participant(s) listed below (“Minor”). I hereby certify and represent that I am at least 18 years of age, am competent, and have the authority to sign this Release on my behalf, on behalf of the Minor(s). I have read the foregoing and fully understand the meaning and effect thereof. I hereby consent to Minor’s participation in the Activities subject to the terms above, and intending to legally bind myself, the Minor(s), and any other parent/legal guardian of the Minor(s), I have hereunto set my hand on the date written below.
